Massachusetts

Medicare and Medicaid Laws

Federal

These programs collect disability data as part of eligibility determination and service provision, especially for individuals qualifying due to disability.

Workforce Innovation and Opportunity Act (WIOA)

Federal

Requires data collection on the employment outcomes of individuals with disabilities participating in workforce programs to measure program effectiveness and promote inclusion.

Public Act No. 21-35

Connecticut

Mandates the collection of disaggregated data, potentially including disability status, by state agencies to address disparities.

Department of Transportation (DOT) Regulations

Federal

Ensures accessibility in transportation services and may require data collection to monitor compliance.

Individuals with Disabilities Education Act (IDEA)

Federal

Requires states to collect and report data on children with disabilities to ensure access to free appropriate public education.

Rehabilitation Act of 1973

Federal

Section 501 and 503 requires federal agencies and federal contractors to collect data on individuals with disabilities as part of affirmative action compliance. Section 504 prohibits discrimination based on disability in programs receiving federal financial assistance; Section 508 requires federal electronic and information technology to be accessible; mandates data collection for compliance.

REALD Data Collection Standards

Oregon

Requires health care providers to collect standardized data on disability status to inform public health responses.

IC 4-3-26 et seq., P.L.269-2017

Indiana

Establishes the Indiana Management Performance Hub to support data collection, analysis, and exchange among executive state agencies, facilitating the sharing of disability data.

Access to Public Health Data Act

Illinois

Requires Illinois state agencies to provide certified local health departments with public health data related to their residents. This includes data necessary for preventing or controlling disease, injury, or disability.

Data Governance and Organization to Support Equity and Racial Justice Act

Illinois

Mandates state agencies to report statistical data on various demographics, including disability status, for each major program they administer.

AB 532

California

Requires state agencies to collect disaggregated data, including disability status, to monitor and address disparities.

Fair Housing Act (FHA)

Federal

Requires non-discrimination in housing but does not mandate disability data collection. Disability data is collected to ensure compliance with FHA regulations.

Affordable Care Act (ACA)

Federal

Section 4302 requires the collection and reporting of data on disability status in federal health surveys to improve healthcare equity and address disparities.

Americans with Disabilities Act (ADA)

Federal

While the ADA itself does not explicitly mandate data collection, compliance monitoring by federal agencies often involves disability data collection, especially related to employment (Title I), public accommodations (Title III), and state and local government services (Title II).

Minnesota Statutes 2021, Section 120B.31

Minnesota

Mandates the collection and reporting of disaggregated data, potentially including disability status, to improve educational outcomes.

Every Student Succeeds Act (ESSA)

Federal

Requires data collection on the academic progress of students with disabilities to ensure accountability and inclusion in education systems.

Public Act 100-0275

Illinois

Requires the Illinois Department of Human Services (IDHS) to collect and publicly report statistical data on the racial and ethnic demographics of program participants for each program it administers. While this act primarily focuses on racial and ethnic data, it underscores the state's commitment to demographic data collection.

Act 113

Hawaii

Requires the collection of disaggregated data, including disability status, by state agencies to better understand and serve diverse populations.

Equal Employment Opportunity Commission (EEOC) Reporting Requirements

Federal

Require employers covered by federal EEO laws to collect and report data on disability status as part of affirmative action and anti-discrimination efforts, especially under the Office of Federal Contract Compliance Programs (OFCCP).

Hate Crime Statistics Act of 1990

Federal

Mandates the collection of disability data in hate crime statistics to monitor and address crimes against individuals with disabilities.

Helping America Vote Act (HAVA)

Federal

Relies on disability data to ensure equal access to voting for individuals with disabilities, including accessible voting infrastructure.

Title 13 of the U.S. Code (Census Act)

Federal

Authorizes the U.S. Census Bureau to collect demographic, social, and economic data, including disability status, as part of its mandate to enumerate the population.
